I have thought about building a fence down the line he thinks separates our property. This is Oklahoma, I will claim the land as mine.

heh that is funny Joe... feel lucky it was just a small tree and not one of these giant Florida sand pines.

On one side of my house is the wife's parents. On the other side is a military guy that is going through a divorce and he is keeping the house. The 14 and 18 year old kids do not live there anymore so his yard of weeds gets cut only every month or two... there are several giant pines from 24-36" in diameter and a good 80 to 100 feet tall,
all on his side of the property line. If I wanted to be a **** about it, I could pressure him to take them down but as they have survived multiple hurricanes, I won't pressure it.
So far, we have been on the east side of the hurricanes center for the last several storms which means that the wind was traveling NW to N to NE, and that means if any one or more did fall, it would be on his house and property. My concern is if we get a storm to the east of us meaning winds blowing to the south, those trees come right down on top of our car, house, utility lines or even onto the inlaws house due to the height... plus my responsibility to cut it up... he is gone at work 12-16 hours per day, plus if he has the standard military hurricane evacuation orders, he will be out of town for at minimum a week but likely longer.

edit: sorry not trying to one-up anyone, just explaining a situation with neighbors I hope I won't have to deal with

Yeah. 6 feet fence is privacy. =)

We wanted a 12 feet fence when we got our pool, city didn't want. :P

Yeah, If I were you I might consider trying to get him to cut them down, a tree can only take so many hurricanes. The only tree I have left in my yard is a big one in the front. Like I said in another thread, if it goes down, no matter which way it falls I will have problems. It's cool this thread is about property lines and trees, your story is welcome.

I will never have a Pine tree anywhere near my house again. Now that they are all gone, if one starts growing nearby, I'll do a ninja-like removal of it when whoever's yard it's in goes on vacation. If it's my yard, it will be cut down as a 2" sapling.

Sorry you had the tree issues Joe. Hope it all works out for you and the fence. Here in Alabama, if you build a fence and it isn't contested within the first five years, that automatically becomes the new property line. Or so the city inspector told us when we were having the plots redrawn out here.

Hell I don't plan on living here for another 5 years. It's not really an issue now that the tree is gone. It's just a matter of who has to cut the grass. I am already cutting it, and will continue to cut it until I move, so that's not a issue either. If I do ever build a fence, I will build it right on the property line, I would rather do that then argue with a neighbor about fence placement.
